To Save Reproductive Rights, President Biden must publish the Equal Rights Amendment as 28th Amendment, says Equal Means Equal in New Video.

April 25, 2022 –Los Angeles. Republican led states are now passing draconian laws blocking women’s rights on bodily autonomy. They anticipate the Supreme Court will decimate reproductive rights shortly overturning Roe v Wade in the Dobbs v. Jackson Women’s Health Organization case. Such a decision will have far-reaching impact that will take women’s rights back about sixty years. No more birth control. No more in vitro fertilization. No treatment for ectopic pregnancies. Procedures we now take for granted will be blocked or illegal.
Equal Means Equal, the national organization that helped propel the ERA to full ratification, has released a new video that explains the ERA will save reproductive rights if it is properly published in the U.S. Constitution as the 28th Amendment immediately.
“President Biden alone has the duty to direct the National Archivist to publish the ERA, based on Article II, Section 3 of the Constitution, that requires that he ‘take care that the laws are faithfully executed,’” says ERA attorney Arlaine Rockey.
The Archivist has a mandatory legal duty to publish all amendments once they are fully ratified, as the ERA has been since January 27, 2020. On that date, the ERA legally became part of the Constitution, the highest law in our country.
President Biden has the power to direct the Archivist orally or with an Executive Order because, as head of the Executive Branch, the President is the Archivist’s boss.
The Supreme Court majority are textualists who require clear language in the Constitution before they recognize a specific right, and they question the prior basis for the rights to privacy or liberty that had been used in Roe v. Wade and other cases to support the right to reproductive decision-making.

Republican led states anticipate the Dobbs decision being released in or before June, 2022. The same legal arguments that undergird the Roe decision also allowed birth control to be legalized in 1965, which means that the consequences of not protecting reproductive rights before the Dobbs decision is released will probably make contraception illegal.
So if President Biden wants to energize the 46 million women who voted for him and Vice President Harris, as well as the majority of Americans who are “pro-choice,” for the midterms, this should be an easy task. The President promised in his campaign’s “Women’s Agenda” that the ERA had been fully ratified and that he would make sure it was enshrined in the Constitution. He reiterated his support for the ERA on January 27, 2022.
President Biden has also been a vocal supporter of reproductive rights.
As natural law principles dictate: "If there are such things as rights at all, then, there must be a right to life and liberty, or, to put it more properly to free life,” says Equal Means Equal founder Kamala Lopez. Women should be free and have full control over their personhood.
Congress did their job when they sent the ERA to the states. The States did their job when 3/4 of them fully ratified the ERA. Biden must do his job and faithfully enforce the laws by publishing the ERA as the 28th Amendment.
